gst

This query is : Resolved

24 July 2017 I am a wholesaler dealing in marble which are imported from rajasthan into jammu. will I get credit of excise duty paid under gst..further if excise duty is not mentioned in invoice..whether I am eligible for same under sec 140

24 July 2017 If at the time of filing form GSTR-1 you have duty paying document which specifically shows amount of excise duty involved in it then you can avail 100% of credit of excise duty. But if you don;t have duty paying document then if item is taxable @ more than 18% then 60% of duty paid at the time of sale is refunded otherwise 40% of tax paid at the time of sale is refunded it is just like cashback.
