Is it mandatory to file INC-21 for the companies, which are incorporated before 31st March 2014

E-form INC.21 is required to be filed by all companies incorporated under Companies Act 2013.

And what about companies incorporated under old act???? to raise borrowings etc.

No need to file e-form INC-21 since the company is incorporated before 1.4.2014.

Under the Companies Act, 1956, a private company could start its business immediately upon receiving certificate of incorporation. Private companies were not required to obtain a certificate of commencement of business from concerned Registrar of Companies under section 149 of Companies Act, 1956. Requirement for obtaining certificate of commencement was mandatory only for public limited company under the old act .
