16 February 2010 Sir,
One of our Customer having unit at SIPCOT near Chennai (Tamilnadu).They exporting their finished goods.

They want material from us with Excise Duty But No VAT. Regarding VAT they are ready to issue FORM -H.

whether it is enough.

Because our Sales Tax Dept people advicing us to get GREEN CARD Copy from the customer.
kindly guide me.

16 February 2010 you required H form, copy of Export order and bill of lading from the customer as per CSt Act, 1956.

16 February 2010 Another point in this regard is that, the exported goods and the goods purchased in penaultimate sale must be same. if the goods exported are different from that of purchased goods and exported goods are having diff. name, identity, marketability, then sale against from H is not advisable. Since some ofthe courts decesion are far and some of them are against the assessee.
