Cannot use form 16AA for AY 2009-10. The reason is the employee had the option of filing the return in form 16AA upto and inclusive of AY 2006-07. For AY 2007-08 and onwards the employee has to file the return in ITR-1/2/3 and is not required to enclose form 16AA with that return.
