16 June 2014 WHAT ARE FILINGS A COMPANY TO DO FOR APPOINTMENT OF A 1ST AUDITOR??

16 June 2014 Appointment of first auditor is governed by section 139(6) of companies act, 2013.

As per section 139(6), first auditor of a company, other than a Government company, shall be appointed by the Board of Directors within thirty days from the date of registration of the company.

In the case of failure of the Board to appoint such auditor, it shall inform the members of the company, who shall within ninety days at an extraordinary general meeting appoint such auditor and such auditor shall hold office till the conclusion of the first annual general meeting.

It is advisable to collect consent letter from auditor before his appointment.

It is duty of the company to inform ROC after appointment of auditor.
