Filing return for refund pertaining to fy 2008-09

17 February 2012 My client KV a share consultant and he received Gross Commission of Rs.17,50,000/- and THEY deducted tax of Rs.1,75,017/-.and issued form 16A for Rs.1,75,017/-.

THE above details pertain to Financial year 2008-09.

So far he did not file any return for the above financial year.

Can he now file return for refund ?
kindly advise. is there any possibility of getting any refund ?

17 February 2012 FY 2008-09 means AY 2009-10
As per section the due date to file return is 31st July or 30th Sept of the AY
In the current case 30th Sept 2009.
As that person have not filled the return till above due date he could have still filed it till 31st March 2010.
He could have still filed the return till 31st March 2011 with penalty of Rs 5000. After 31st March 2011 he can not file the return on his own. Means if and only if the department make his assessment and ask to file the return then he can file the return.
