Export under Rebate plus other export incentive

06 February 2010 Dear all

as we are newly established unit we have enough cenvat credity by procuring capital goods. So I would like to know whether we export under rebate and advance licence/DEPB so that we can incash cenvat Credit and receive advance licence/DEPB for procuring imported raw material without payment of duty.

Please advise me sir.

07 February 2010 Yes export under reabte would be possible whereby you would utilsie the credit. DEPB shceme is applic able for some products and it does not bar the removal under reabte of some consignments which are not under DEPB.
Pl refer a good commentary on export benefits as there could be some good combination.

Further i would like to clarify that we have cenvat credit against procuring of Capital goods. when we export our finished goods, can we go for rebate against Capital goods Credit.

Please clarify.

08 February 2010 Yes, you can utilize Cenvat Credit availed on capital goods for payment of Excise duty on export of finished goods, subject to other conditions such as 50% in the first year etc.
