Please solve my below query our one of the employees is already registered for ESI before three year but last year he is cross the maximum limit of Gross salary ie. Rs. 22000/- now is salary is reduced due to his performance last year is not upto mrk hence his salary is reduced by Rs. 2500 now is Gross salary is Rs. 19500 . now is again eligibility for ESI please clarify for registration process we tried his registration using his old ESI number but which is date of appointment is mention while registration in software old actual date of employment is not taken because old date is last 4 years.
Please tell can we registration his esi for date of appointment is today date ?

ESI Eligibility & Re-Registration for Employee Previously Exceeding Gross Salary Limit ESI Eligibility Limit: The gross monthly salary must be ₹22,000 or below to be eligible for ESI coverage. Employee Previously Covered But Became Ineligible: If the employee's salary crossed ₹22,000 in a previous year, he/she becomes ineligible for ESI from that month onward. If the salary later reduces below ₹22,000 again, eligibility can resume. Re-Registration / Rejoining ESI after Becoming Eligible Again: ESI rules generally do not allow continuous coverage if the employee was ineligible for more than 6 months. If the employee was out of ESI for more than 6 months, a new registration is needed. The date of appointment for re-registration can be the date from which the employee became eligible again (i.e., when salary dropped below ₹22,000). You cannot use the old date of appointment if the gap exceeds the permissible limit. Practical Steps for Re-Registration: Register the employee as a new entrant in the ESI portal. Use the current date (or date when salary came below ₹22,000) as the date of joining. Assign a new ESI number or reactivate if possible under ESI portal provisions. Important: The old ESI number generally cannot be reused if there is a long break. For exact procedures, check the ESIC regional office guidelines or consult with ESIC helpdesk.
