31 July 2010 Sir,

One of our client had applied for registration of ESI and also collected Employees share of ESI but could not remit the same since the registration was still pending.He remitted it along with his share of ESI after getting Registration which he got beyond the due date of payment.

Whether there will be disallowance of any amount paid after the due date of payment of ESI?

31 July 2010 it will alloweable. keep it pending may be some amount paid by DD as advance at the time of application of registration. to be adjusted if not then full amount to be deposit without interest.

Could you elaborate a bit.
Will the employees share of ESI collected when the registration was pending and paid after getting registered be treated as income under the Income Tax Act. This pertains to Ay. 2010-11

It would be allowable even if deposit after due date subject to the fact that it is deposited before the due date of filing the return u/s 139(1).

else it could be claimed in the 2011-12
