17 October 2012 Details of case are as under:
ITR fillied of assessee for the AY 2011-12 within due time but forget to enter the Depr. Chart seperately in Computax Software due to which get demand notice for difference on account of DEPRECIATION.

Considering it as Mistake we filled the RECTIFICATION Request U/S 154 with correctly filling the DEPRECIATION CHART. But again in Rectification order get the demand notice of same amount.

Now we wish to revise the ITR u/s 139(5).

So Our query is:
1. "WHETHER REVISION OF ITR POSSIBLE AFTER
RECTIFICATION ORDER RECEIVED"?

2. What is the REMEDY available to us regarding rejection of DEPRECIATION CLAIM in the RECTIFICATION RETURN FILLED????.

Pls guide in detailed the correct procedure & how to come out of this situation.

Earliest reply is highly appreciated.

Thanks

18 October 2012 Yes you can revise the return even after rectification order.

Revision of return is not permitted if assessment has been completed. Rectification order is not an assessment order and accordingly the return can be revised.

Very Thanks

21 October 2012 1. You should file a revised return.
2. In the revised return you should claim the amount of depreciation.

The same shall be allowed as deduction.
