13 August 2012 My wife is doctor. Her income is from
1. the fees paid by hospital, through Form 16A and tax dedcucted under 194J. Total fee for the year is INR 5.0 lacs PA.
2. Interest income from deposit in banks.


My query:
1. I am using form ITR IV. Is this correct ?
2. She is not maintaining books of accounts. Can I declare her as not maintaining books of account.

13 August 2012 1. Yes ITR 4 is applicable since such income is taxable under the head Income from Business or Profession.

2. Since she is a professional she HAS to MANDATORILY maintain books of accounts.
If you show not maintaining books of accounts in the return, penalty shall be levied.
