05 January 2016 A O has Pass an Order against my Client after disallowing an unsecured Loan taken Three Years Back, as Person From whom Unsecured Loan was taken Could not be presented as he was out of City for medical treatment and When we Produce him after his Coming Back , AO has refused to accept saying that Order has already been Passed, Point to Note that there is Proper TDS on Interest Given and Form 16 A submitted has also been Produced

Now I want to know whether Appeal should be Filed or Revision Application Should be Filed

05 January 2016 Appeal before the CIT(Appeals) is the right course of action against an order passed u/s 143(3).

Ps:- Remedy U/s 264 contemplated by the Legislature is only to meet a situation faced by an aggrieved assessee who is unable to approach the appellate authorities for relief and has no other alternative remedy under the Act.
