Delay in payment of Service Tax due to BHARAT BAND

07 July 2010 Dear Expert,

can i pay the service tax liability after 5th july (i.e. on 6th) without interest due to BHARAT BAND

07 July 2010 A direct answer is not possible.

If it can be proved that the Bank branch was closed on 5th, then recourse can be taken to Clause 10(1) of the General Clauses Act. The payment made by you on 6th shall be treated as deposited on 5th.

07 July 2010 Yes and few of the banks were working on that day. So it might be difficult.

Normally in case the payment made on the working day following 5th of the calendar months which was a holiday, would be considered as having been paid on time. But it is for u to prove.
