13 July 2013 Whether filing ITR 2 where ITR 1 was applicable would lead to a defective return filing?

13 July 2013 it will be treated as if no correct return is filled.

defective return is where u filed correct return applicable but contents are defective which can be cured.

if wrong return is filed then its not defective but no return filed is counted.

13 July 2013 i file return through a software

this time there was a rule saying if income u/s 10 > Rs. 5000, then ITR 1 cannot be filed.

while filing return due to hra exemption etc. all returns filed by me for salaried people came in ITR2.

however one discussion said that such hra income etc would not be considered for Rs 5000 purposes and ITR 1 is to be filed....

what should i do?

13 July 2013 no then u correctly filed itr2 in ur case.
