Deduction under section 80d in respect of mediclaim

18 June 2012 whether a mediclaim premium paid by Son from his non Taxable Income in respect of himself & his parents can be claimed by her mother/father having taxable Income relevant to Asstt.Year 2012-13 & same can be allowed as deduction in his/her taxable Income under section 80D of I.T Act.

Please reply.

18 June 2012 No. The deduction is to the payer only. So in this case the father/ mother cannot get deduction. Further the mediclaim shall be paid out of taxable income only.

18 June 2012 One of the basic condition in Sec.80D, premium should be paid from taxable income in this case payer does not have taxable income and actual beneficiary is not paid the premium. so cannot claim the deduction both parties.
