25 July 2013 Company secretary appointed on 03.06.2011.Show cause Notice received from ROC for the financial year 2010-2011. Date of signing of balance sheet is Agust 2011. whether company secretary is liable to be compounded.

please reply to my query with certain case studies.

First of all check,that balance sheet is signed by company secretary or not.

Because, your secretory is appointed as on 03.06.2011 and audited Balance sheet is is adopted in August 2011, so name of the secretary should be mentioned.

25 July 2013 cs not signed the balance sheet. how ever in XBRL mode in the 23 AC ACA mentioned cs name.

25 July 2013 Yes, in that case to CS will be liable to response the Show cause notice.

One more thing, the CS is required to sign the balance sheet.
