29 March 2012 When does it become necessary to appoint an Auditor under the Companies Act 1956.

Hi

With in one month of registration of company, it is required for company to have a an auditor.


Section 224(1) of the Companies Act says that the Company must appoint an auditor at each annual general meeting to hold office from the conclusion of that meeting until the conclusion of next AGM.

Section 224(5) of the Companies Act, says that the company must appoint first auditor with in one month from the date of incorporation of the company.

This section 224 of the Companies Act, 1956 will apply on both public as well as private limited company.
