A Pvt.Ltd. co. has been struck off as a defunct company u/s 560. by letter of the ROC dated 1 July 2008. The ROC/MCA records also indicate that the striking off was for a failure to have the minimum prescribed issued share capital within two years of the introduction of the Companies Amendment Act,2000. No other compliances, i.e accounts etc. appear to be in place. The company claims ignorance. What would be the effective date from which the company could not have acted, traded etc. 1/7/08 or 2002

Effective date is 13/12/2002,why because THE COMPANIES (AMENDMENT) ACT, 2000( ACT NO. 53 OF 2000 )was effective from 13th December, 2000 in which two years time was granted to comply the requirement of increasing the capital.
