17 March 2013 You will have to go for compounding of offence u/s 621A of the Companies Act but before going into compounding file the ROC returns. Check the defaulting section for quantum of penalty.

Late fee should be paid 9 time of normal fee on every Forms which will be filed by you from 2009.

If your normal fee is Rs. 500/- then late fee will be 9*500 = 4500/- and total fee will be Rs. 5000 (Rs. 500+4500).

18 March 2013 Compounding Of Offence How to proceed whether any notice to be received from ROC for Compounding ,
Further whether same can be audited by any other auditor other than first auditor appointed at the time of formation or NOC to be taken from first auditor for that also

30 March 2013 You will receive a notice from ROC. First of all file the return as soon as possible. NOC from auditor will be required in case of change in auditor.
