Commission received from abroad for connecting trade

27 September 2016 Hello sir's

For linking trade between UAE and indonesia i am receving commission on percentage basis in india. kindly advise whether a service invoice to be raised? if so how tax to be charged.
2. 10 years i was employed in indonesia since more than a year i am in India. i have my NRI account in india. can the commission taken in NRI account? and will i have to pay tax.

please advise.

27 September 2016 1 No service tax applicable on this service as the service is rendered out side India.
2 No tax payable on income earned out side India as you are a resident but not ordinarily resident.

Thank you for your reply.

As mentioned currently i am in India from more than 365 days. so for any foreign currency received in my account should i have to pay tax. if so how much should i pay.

27 September 2016 If your stay in India during the previous 7 years exceed 730 days, then only your foreign income is taxable in India. So presently you need not pay any tax on foreign income.
