10 December 2015 I have commercial property in Delhi that I want to give on rent.The rental value is about 80000 per month.I want to do the registered rent deed with the tenant .I live in U S A.Is it possible to sign the deed without coming to India,if yes how,if no what should I do.Thanks

11 December 2015 For signing the rent deed you have to come India as the place of execution of the document is very important. The place of execution of the document is mandatorily required to be mentioned in the deed. Since the rent deed in India will be notarised and notary will verify the signature of landlord and tenant.

However, as an alternative you can issue a Power of Attorney in favour of any person in India who could execute the rent deed on your behalf. The Power of Attorney must be notarised by notary public and consularised or apostilled by the Indian embassy in the country of your residence.
