CENVAT credit

please tell if my registration is done on 01/07/2009 and I started manufacturing on 01/04/2010 now for the input goods I will not be allowed to take CENVAT Credit but now if I agree for the liability and pay excise of such months, is there any appeal / tribunal order that allow me to take such credit after payment of excise of that 3 months.

Input credit is available where the same is used in or in realtion to manufacture of excisable goods liable to duty of excise.
The stock of goods in RM, WIP nad FG stage could be converted inot the RM stage and credit on such inputs available from the date of opting to pay the ED.
For past periods also ED can be paid and entire credit availed. The differential duty invoice may have to be raised on the customers who can avail the credit.
