MY QUERY IS BELOW:-
I am working in a partnership firm. In this firm Sales tax assessment is not being done from AY 2005-2006 TO TILL DATE.
1. IS SALES TAX AUTHORITY PENALIZED US?
2. WE HAVE MANY C FORM SHORT SO THEY ASSESSED TAX ON THAT SHORT C FORM

3. IS ANY INTEREST CHARGED BY THEM

AFTER FINISHING THE ASSESSMENT YEAR WHAT IS THE TIME LIMIT TO DO DONE THE CENTRAL SALE ASSESSMENT??

IS MANUAL ORDER APPLICABLE FOR ASSESSMENT??

01 August 2012 The CTO have the authority as to how your assessment should be completed. The CTO is also entrusted with the power to make CST assessment. You can make request to the CTO to grant time to get pending Form Cs from your Customers.

Sales Tax assessment is often completed by accepting your returns as it is now in VAT laws. As many dealers do not bother to file 'C' forms as claimed in their interstate sale invoices such cases are selected for assessment. When 'C' forms are not filed within the statutory period of three months they can levy full CST along with interest and penalty on the additional levies. No further time is allowed as per CST Act. But before passing such an order they should issue a notice and give some time to file the required CST forms..MJK
