10 October 2007 A COMPANY IS MFG UNIT. JOB WORK IS DONE BY CONTRACTORS & OTHER UNIT DURING THE PERIOD JUNE-2005 TO MARCH-2007. WHAT IS ESI LIABILITY OF COMPANY & IF COMPANY IS LIABLE TO PAY ESI. THEN, CAN INTEREST BE EXEMPTED. IF YES. BY WHAT WAY?

this job work is done of amtd 20 lacs appr. but contractors' are not regd with ESI. These are proprietorship/partnership concerns. but not related to my co. and their units are situated on other places.

according to ESI official this is OUR liability to pay ESI liability if parties has no ESI registration.

10 October 2007 The ESI is applicable for all mfg units even if it is single member. The company is liable to pay ESI. Every Jobworkers are liable to pay ESI otherwise the Mfg company has to deduct ESI on behalf of contrators and pay to the govt. Any penalty is levied which is not an allowable expenses but interest is incidental to the business it is an allowable expenditure.
