11 March 2015 hello, i have purchased a flat. i made 60 % payment. flat booked in 2013 now builder is demanding money or else he will break the contract. can he do that?? payment condition was decided on mutual understanding. can i ask him for more gress period?

11 March 2015 whether u had signed any contract in writing u have not mentioned?

11 March 2015 yes i have agreement for purchase but payment conditions were mutually decided orally..

11 March 2015 then you cannot go to court as court will ask for evidence in writing..orally how court may believe u even when u know ur ri8/

11 March 2015 ok thanks. what will be the procedure for cancellation & how much will be the refund..

11 March 2015 actually all such term must be have been agreed at tim of drafting contract in writing and signing the same and in this case refer to clause in agreement wat it mentions in case of cancellation of contract..if it doesnt mention anything then actually as per law full amount has to be refunded.
