tds on contracts

during the last year we have not deducted tds on contracts on of our creditors. can we deduct tds on last year bills during the year, if yes wat about returns submitted already? pl help..

HI SIR KAPIL G THOKRE g m sir sir i have completed my pcc group 1 n i want to know who will give best coaching for group 2 in hyd. moreover my pcc attemt is in may 2009 can u tell me it is better to take coaching for group 2 now only or after 2 or 3 months pls suggest sir.

services t a school

A gentleman is providing turnkey consultancy for setting up a
school. In my opinion, as a Consultant he needs to collect and
deposit service tax related to the service. When he approached the
service tax authorities for registration, he was advised by an
officer that as he is rendering consultancy for an educational
activity he need not collect and deposit service tax. Therefore, he
need not seek registration. I am not sure if that is the correct position as per law.

The school project is educational in nature, but a person who is
rendering consultancy to set it up on turnkey basis is involved in a
normal commercial activity and should therefore collect and pay
service tax.

I would be grateful if our learned members could give their opinion
on the issue.

sir, i'm doing B.com(H) 3rd year from regular college and i've done CPT in nov '07.Is it possible to do articeleship in college hours? Or is it allowed by the ICAI to do articeleship during college hours? Because timing of articeleship and college classes are same.

What is the remedy to a deductor if deductees from the sums paid to whom are ot itimating PAN.
Can the duductor be penalised for not quoting the PAN of such deductees.
In some cases as noted below the deductee may not be giving his/her PAN - what is the remedy. Is the payer authorised to withhold the future payments.

- Payment of taxable pension to employees retired 3-4 years back.

- Payment to contractors where PAN was not taken earlier

regn. query

I had cleared the PE II exam in May’07. Then I applied to the ICAI for registration in the Final (old) course with articleship in in August’07. However I received an objection letter from ICAI in Nov’07 due to “breaking of working hours” as I was still pursuing B.Com at that time. Meanwhile I had received the study materials for Final and subsequently discontinued articleship in Dec’07.Now, in February I want to re-apply for regn. as the B.com classes are over.I have the following queries-
1. What are the documents that I have to send to ICAI? Do I have to fill up the forms again? What is the amt. of fees I have to pay?
2. When will I be able to give the exam ,after 2 yrs.or 2.5 yrs of articleship ?
3. How will I receive the study material for the new course?

On the Accounting assumption

Dear sir / madam: who ever it is.
I am a CPT student and now I am in the articles period.Coming to the point,

One of the basic assumption in the Accounting policies is Accrual basis of accounting. My doubt is that "Service tax is paid on the actual amount received", which means mercantile basis. Is this not violating the assumption?
