Hi,

I am going to purchase a plot and then construct house using my Capital Gain Account.

The owner of the plot is asking to mention the total value in "SALE AGREEMENT" and "SALE DEED" to be different.

SALE AGREEMENT (AOS) will mention the Total Sale Value (e.g. Rs.70 lakhs)

ABSOLUTE SALE DEED (ASD) will mention the Guidance/Market Value (e.g. Rs.50 lakhs)

Is the above allowed and legal ?

Let me know by doing the above whether I can withdraw the total amount of Rs.70 lakhs and registration fee of Rs.3.25 lakhs from my CGA using FORM C & D ?

NOTE: ALL TRANSACTION THROUGH BANK ONLY (INCLUDING THE DIFFERENCE AMOUNT)

GST ON courier Agency

We are courier agency.
We provide courier service to companies, normal people and 4 banks in our area. we issue invoices to every one and also 4 banks monthly, but payment not received from 4 banks on monthly basis, they paid every 6 months once.
Problem with Only these banks. Remaining every one paid monthly.

My query is,
GST paid monthly or 6 months particularly these Banks?.
Tell me Any solution for payment of 6 months only otherwise i pay personally my own money.


I file gst every month and paid gst@18%. Problem with this Banks only.

Claiming TDS of outside India

One of my Clients is Resident for F.Y. 2019-20. He went to Afghanistan and earned an income and tax was deducted at source at Afghanistan. As he is Resident his global income is taxable but how can I claim the Refund of that TDS amount ? plz assist me

Capital Gain

My assesse has a capital gain on sale of residential plot. He wants to save the capital gain by investing in a house property. Can he purchase the house in his daughter's (married) name to save the capital gain?

Last date for filing return

I am facing issues with itr 2 excel utility. It is not opening normally and showing errors. many people in friends and family are facing the same. Is there any extension in the last date of filing return as many people are facing this issue

Place of supply

Service provider is in maharashtra ;
place of supply is in all over India; service receipient is located in Singapore ( out of India )
My questions are as under
Whether SGST and CGST applicable
Or
Whether IGST applicable
Or
Other wise any

GST Credit

SIR
We are trading of tyres. We have decided to retread some old tyres. Retreading units will issue GST bill on the services provided. Can we avail that GST input credit and utilize it towards the sales?

Is GST refundable?

Hi I bought a house in June 2017 of 1.14 Cr, registered in Oct 2017 and paid SDR 6.23 Lakhs, GST 12 Lakhs paid in Sep 2017. Cancel the booking due to inability to pay balance amount. Cancellation registered in Jan 2019. Builder says GST amount is not refundable. I doubt his statement. please can you confirm if GST is refundable to me completely?. Is there any process by which i can initiate a refund just like stamp duty? Thanks in advance for any help.

QRMP clarification

In fixed sum method of payment for first two months of a quarter, pre filled chalan will show tax payment as 35 % of previous quarter for each month. If it turns out to be less than actual tax to be paid, there will be no interest charged when we pay balance tax and file gstr3b return for the quarter.
In SAM, do we have to pay 35 % of self assessment of tax with ITC considered or we have to pay 100 % of self assessed tax. I am not clear.
Assuming that here also I pay 35% of self assessed tax for first two months of a quarter, suppose, in third month if it turns out that actual tax liability for first two months of this quarter is more, will I be charged interest for first two months, though I pay balance tax in third month and file timely quareterly return.
Also, this QRMP scheme, it will start for Jan 2021 to March 2021 quarter, so for January and February, I will have to pay 35 % tax each paid in October to December 2020 quarter. Is understanding correct.
Also all output details like inter state supply (table 3.1) can be given for 3 months put together in April while filing GSTR3B quarterly return - is my understanding correct.
Please guide for each point.
