Its very urgent...

A ltd (a Goods transport agency-(GTA)) got a contract from X ltd to transport the goods from Surat to Ahmadabad.

Now A ltd have in turn outsourced this work to another local transporter (B ltd).

As we know the Service tax is to be paid by service receiver in case of GTA.

Doubt:

in the above case there are factually two service receivers i.e 1st is X Ltd and 2nd is A ltd (who took B ltd's service by outsourcing the work.

Can any one tell me whether A ltd is liable for service tax in this transaction ?

If service provider (Man power service) not registered in service tax

Querry 1.
whether service receiver is liable to pay service tax under reverse charge.

Querry 2.
If service receiver pay then 75% or 100% under reverse charge.

Plz suggest on urgent basis.

Service tax on works contract

Dear Sir,

My name is Manoj Kumar Gupta , residing at Kolkata , working as Sr. Accountant in M/s AKJ Engineers Pvt.Ltd.

I have a doubt in my mind regarding reverse charge mechanism in relation to works contract service :-

We are a Pvt.Ltd. company doing Civil works contract to the tune of Rs.20/- crore plus , We are procuring works contract from the construction companies & Govt. bodies and sub leting the service part of the job to small sub-contractors. They are doing the labour job only on sq.ft/ Sq.m basis . All the required materials, consumable , T & P are being supplied by us only. All these sub contractors are proprietorship concern and small contractors below the ceiling limit of 10/- Lac's.

Now my question is that these small sub contractors are not registered with service tax , under the reverse charge machanism wheather we are liable to pay the service tax on all these sub contractors. and wheather we are entitle to set off the said paid service tax with our output or not.


I will be kind enough if i find the answer of my query . Your early action is highly appreciated by me.

Can you explain me about this notification about that points.....
I. The taxable Service,-
(A)(iv)provided or agreed to be provided by,
(A) an arbitral tribunal, or
(B) an individual advocate or a firm of advocates by way of support services, or
(C) government or local authority by way of support services excluding,-
(1) renting of immovable proprety, &
(2) services specified in sub clauses i, ii, iii of clause (a) of sec. 66D of the finance Act, 1994,
ento any business tity located in the taxable territory
can you explain sepretaly in both point about to any business entity? What is meaning of business entity in both point clearly?

Legal services

Hi ,

A person charged to our company 75000/- for his legal services bt didn't charge any service tax. he told us to pay the service tax from hi sside to the govt .

can anyone help me for this ....how to pay service tax & what would be the amount of tds ? tds will charged on 75000/ or after adding srevice tax & wat is percentage of tds

Pls help me in computing the service tax liability including int for delay in pmt of service tax.

I had paid freight of Rs.47215/- to GTA on 04.02.13. As a Service receiver i need to pay service tax under reverse charge mechanism. As the due date was on 05.03.13, I still have not paid service tax due to delay in Service tax registration. My Question is do I need to pay any interest? If yes, then how much? Kindly show me the calculation.

Sir,

1. Kindly explain that, Service Tax Under Reverse Charge Mechanism, what is the cenvet Credit portion, if service provider charges the service tax 12.36 %, In that case if our portion to liable to pay the service tax is 50% of the service tax i.e. 6.18% and remaining 50% by the service provider.

2. In case service provider raised bill without service tax, in that case what is the treatment by the service receiver under reverse chare mechanis ?

Sir,

One of the my client is Professional in playing musical instrument.

He getting income through Playing instrument in INDIA AND ABROAD..

Please suggest whether he is covered under SERVICE TAX Act ?
