Service Tax on Selling Commission

Sir,

I am working in a Kerala based PSU having branches all over the Kerela.It is enagaged in the business of productions and manufacturing of electronics goods as well as software products.The company also have a five subsidiary units,fully incorporated as company under the Indian Companies Act,1956.The Holding Company's productions as well as proudctions of subsidiary units are selling through the marketing offices of Holding Company,w hich have various offices all over India.Holding Company have eneterd in an agreement with the subsidiary company realating to the selling of products of subsidairiy units.Subsidiary company is required to pay a commission of 5% on the net sales effected by the marketing offices.My question is whether the commission received by the Holding company is laible for services Tax?Monthly expenses on behalf of some of the marketing offices is incurred by the said subsidiary unit which will be adjusted with the above commssion at end of the each quarter.Based on the above circumstances what is time limit for charging/paying the service tax liablity?

service tax refund urgent

sir
we are manufacturar/exporter we are taking the service tax credit in our service tax books same ass the excise duty
some one told me that we cant get the whole type of service tax credit in our cenvat book
there are some service on which we can only get the refund but can`t treat as cenvat

pls advice and pls suggest the whole porcedure of the service tax refund which we have to follow and which documents we have to produce before the Excise department
although we are getting the refund of the excise duty on the basis of the Proof of export documents
pls advice

We are 100% EOU of Computer software and receiveng services and Paying service tax on input serives,
I want to know on which input services we can claim refund for Serivce tax. because service tax officer is saying we can claim only Under Notification No.17/2009 New Delhi, the 7th July, 2009 on specified services i.e only 16 Services.
if not than please mail me relevent required notification or material so we can claim service tax refund.

Dear Sir,

What is rate of services tas should be charges on advertising agencies.
Second he charge services tax to party 8%. (on profit of margin 15%) b’coz publication given advertisement agencies 15% margin on bill.

For example.

Bill Amount Rs. (To Party) 10000
given Discount to party 7%
(out of 15%) 700
After Dis. 9300
(profit of Margin 15% Rs.1395)
Services Tax 8% 111.6 117

Total Bill Amount Rs. 9417


(Profit of Margin 15% Less discount 7% Balance Margin 8%)
This is possible.

Wrong payment of Service Tax

While making a e-payment for Interest for Mr A, we had mistakenly entered ST regn of Mr B and processed the payment.
Pl. advise:-
1. if this payment can be adjusted to the
credit of Mr A.
2. if the payment can be adjusted with
regular ST liability in future (not
interest).

Dear alls pls advise

As per the decision of the H`nerable DELHI HIGH COURT the is no service tax on rent of the immovable property

Though the Supereme court decision is pending

if we follow and not pay the service tax on the rent which we are paying to our landlord and giving the undertaking that if the decision will go against the assesse and have to pay the service tax with interest and panelty

and we do like that

if yes could we use our cenvat credit of service tax and excise duty for paying that service tax

pls advise

Why no taxes for SEZ locations

Hi,

My query is that why SEZ location companies are exempted from the Tax.
Please provide the details about the SEZ means why it been treating like this.

one company having two business one dealership of car and an other is miniral grinding and sales.in the frist business company having input of service tax on advertisement.in the other business having liability to pay service tax on GTA company may taken input credit of service tax paid on advertisment in GTA or not
