service tax on roads and drainages


If a public or private company gave a contract to a private or public company to lay roads and drainages within the factory, in that case whether Service tax is applicable under Works contracts under Service tax Act?

Service tax credit

My client is a mfg company. It has mfg (registered office)and admin (head office)locations. Centralised SAP accounting system.

Can it claim service tax credit on exps. like telephone, courier, consultant charges of admin location - head office? can service tax credit be claimed on service tax paid on rent at head office?

service tax expense or liability?

i came across 2 different aspects regarding service tax while finalisation.. plse help me to understand the same..
one company treated service tax A/c under duties & taxes under current liability & also claimed service tax credit which they have collected on purchase bills to be set off against their ST liability.. & if any amount remain to be claimed they pass it on to next month for set of agnst that months liability
2 nd company
they created service tax under indirect expense A/c & their collection of ST i.e. on purchase bills shown in final accounts as indirect expense in p & L A/c as thier debit amount exceeds their credit i.e ST payable by them in debit notes raised by them...
i dont understand treatment given by 2nd company as their accountant told me that ST is indirect expenses but i think they are showing ST as expense ( & not taking benefit of credit ) to reduce the profit .. plse help me to understand the same

how to utilise of Input service tax credit in following case
if the part payment is made in advance (month january,09) and bill received (march,09) and balance payment is made in the March,09. please guide in which month crdit will be utilised?

Credit of Service Tax

Sir,

My Service provider has raised a bill aganist me as service charge and expenses reimbursement on which he has charged service tax i.e service tax on (Service Charge+Exp Reimbursement). i have paid paid the whole service charge and service tax what ever my service provider has claimed but disallowed the exp what ever they hav claimed. i have taken the full service tax credit also. is it correct?

Can some one calrify?

we are an t shirts export company and pay foreign agent commission through bank transfer.
recently the audit people from service tax department informed us that the ST on foreign agent commission to be paid wef.09.07.2004. we check other sources to find the effective date is only 19.04.2006.

next point whether foreign bank charges deducted in euro on realisations comes under perview of service tax, if yes are we to pay of the indian banks are liable to pay that.

the auditors who came for audit are not clear on this matter. how can the department send such igonorant auditors

EXEMPTION OF 10 LACS.

Is it true so that exemption of 10 lacs is available only for first year and for subsequent years it is taxable for whole amt.

intt on late payment of service tax

why intt on late payment of service tax is not an allowable expense..where it is written under income tax act..even though it is not a personal tax like income tax or wealth tax...
