GTA & Partnership Firm & ST Liability

Dear Friends,

Need clarification on the following queries

1) A firm bein service receiver of goods transport via road service need to register and pay ST. Being unaware of such provision never made arrangements for such ST payment. subsequently aft registration how to compute of such and remit? can batement of 75% be had? will the whole ST be expense to firm as same cant be recovered from the GTA provider or on his ST portion.

2) need clarification like havent made arrangement for ST and now have to file ST means how to adjust the same? should the firm bare it as expense?

3) Had the GTA was regular ST payer and filed their returns and now the firm subsequent to its regist also pays wont it be double payment of ST for same service?

4) wat is current Interest rate for delay in ST remitance. plz give section or notification No. for the same

Service Tax on Mobile E-Recharge

Hello,

I wanted to ask that if any person is dealing in mobile recharge i.e. he is authorised dealer of mobile recharge value for a mobile service provider in a particular region for selling the same to the mobile retailers in that region, then under what category of service he has to get registered for the purpose of service tax, as the mobile company is asking for service tax registration before giving the dealership to the person.

Reverse Charge under service tax

As per the provisions of Service tax The input credit can be claimed only when the payment for the same has been made.
The company for which we are doing the audit deals in import of services and takes the credit at the time of booking output tax entries.They say that since the cashflows of the company are significantly affected if they deposit output service tax first and then claim for the refund since they do not have other output tax collections against which they can adjust the input for import of services.Moreover the exchequer(govt) do not stands at any loss through this provision.I want your advice whether the same can be a acceptable plea?

Can i register under service Tax Act as Propritor ship company for running Financial Business(Money Lender),if it can what is the rate of Service tax, it means is there any abatement.how tax would be caluculated,and any more registrations are to be done to run & be legal.

Respected Experts,

A Company has service tax input credit of 2,00,000,00/- after setoff of service tax payable every time . Can the company start an another service different from the old and claim the input credit of the old one??
pl clarify with necessary case laws..

Cenavt Credit on Sales Commission

We are engaged in manufacturing of excisable goods, both for the domestic market as well as for exports. Whether the we can avail the Cenvat Credit of service tax paid on sales commission and utilize the said Cenvat Credit for the payment of duty of excise on excisable goods.

CENVAT CREDIT

Case: There is an electrical contractor who undertakes the contract of commissioning, testing, installation of various electrical jobs. He is also to buy the wires, cables, switches himself and install the same. The contract is composite as the company will make a lumpsum payment to the contractor (i.e for service as well as the wires cables and other accessories used).

Question: Can the contractor take the input credit of the excise duty paid on the wires, cables, switches, accessories against the services tax liability?
