My father wants to become First Stage Dealer. How can my father issue invoice to purchaser so that he can avail CENVAT Credit and also the gross margin of the business is not disclosed to the purchaser.

Suppose, 5 item purchased for Rs. 2,10,000. One item is sold for Rs. 45,000. Whether my father can issue bill for total of Rs. 48,460.8 i. total of Rs. 45,000 and proportionate excise duty of Rs. 3,460.8 (8.24% of Rs. 42,000)

Duty Concession

For a unit under EPCG are there any concessions available for the excise duty on the indigenous capital goods. If not the duty paid can be availed as CENVAT credit.

Cenvat on capital goods purchased

Hi,
If a company purchases some tools or spare parts which are although of Capital nature but due to small amts, charges in books in same year. Now the Excise duty paid upon the purchase will be considered as for Capital goods and be eligble for input in two years or can it be claimed in same year in full.

Excise credit on sales return

My issues are

> When excise paid goods are returned to the factory for repairing or as rejection of the goods due to wrong category dispatched then is it compulsory that the goods should be returned in the same condition?
(i.e Supposing the whole water pump set has been sold and only pump has been returned then can we take credit proportionaltely of the pump amount or not)?

>And if at the time of sales the excise rate is 10% and when it is return the excise rate has been reduced to 8% then at what rate the seller should take credit (10 or8)?

Sub Contract of SEZ by a 100%EOU

We have been facing a peculiar problem. We a 100% EOU undertaking job work for SEZ as per Rule 41 & 42 of SEZ Rules 2006. The SEZ is sending entire raw material, consumbales & packing material to us for job work in original packing.

We after processing the material repacking the finished goods in seperate packing boxes which are sent by SEZ and then processed goods sent back to SEZ.

We want to sale the unused (un recyclable) packing material directly from EOU unit into DTA without payment of duty. But the Specified Officer of SEZ not allowing with the ground that there is no such provision. We have no other option except to send back entire un used packing material back to SEZ. which will finally be sold duty free from there.

We are unncessary bearing the extra cost of freight merely on the ground that there is no provision in SEZ Rule. Please let us have your view point and suggestion to come out from this problem.

Statutory Registers

Hi Experts,

Pls advise that which registers are statutorly required to be maintained by a manufacturing unit like DSA under Excise rules and whether these have to be maintained manually in prescribed format or they can be maintained in computer also? Pls specify the notification details if avialable.

Excise paid by Software company

Hi,

A company dealing in export of IT services purchases some computers or other items on which it pays Excise duty. Can this excise amt be taken as input credit and refund be claimed for the amt along with refund claim of Excess of service tax input credit over service tax output liability?
