rebate claim on supply to mepz unit

sir,

I am S Natarajan working as sr manager accounts in Electromags (A division of EAPL) at cehnnai

one of my buyer is at mepz zone at chennai. I am supplying my items to them

I am invoicing them in their local address at chennai in foregin currency.

I am also getting my payment in foreign currency only from abrod.

will u please give me the notification under which supplies made like this is eligible for excise rebate?

pls give me the notification no & date

Dear all,
As per Budget,2009 some amendments has been made in Cenvat Credit Rule,2004 one of that is:
In Rule 2 Clause (k) in Explanation 2, after the words “factory of the manufacturer”, the following shall be
inserted, namely:-
“but shall not include cement, angles, channels, Centrally Twisted Deform bar(CTD) or
Thermo Mechanically Treated bar(TMT) and other items used for construction of factory
shed, building or laying of foundation or making of structures for support of capital
goods”.

My Question is can I avail Cenvat Credit on Structural Steel for support of Capital Goods, purchased before 07/07/2009.

MRP based excise

We manufacture an electrical product which falls under MRP based valuation. For contract manufacturing for a BRAND, we pay excise duty based on Brand's MRP.

Some brand now advises us that we can print the brand and mark ISI but dont pack it, but despatch it as a wholesale pack. They would pack it and release it in their dealer market after paying MRP based excise. I.e. we are sending unpacked branded good ISI marked.

AND they want us to bill it and charge excise at transaction value and not on MRP-abatement.They would take the CENVAT, pack it and charge excise based on their MRP. They wish to show MANUFACTURING at their for some purpose.

The question is CAN WE charge excise from them at transaction value?? if we are selling brand printed but in unpacked condition in wholesale packing(so unsuitable for direct retailing and hence would not attract MRP based valuation acc. to Weights and Measures Sec 4). i understand there is reference case - VISHVAM supplying to CANON industries, Ernakulum.

Exemptions

We are a Small Scale Manufacturing unit.Our sales for last three years are 120L,162L and 175L.We use red mud in 25% of our products. The qty. of red mud used is around 33% by weight of the product weight.This qualifies us for the exemptions under 03/2005.
Our annual sales figure remain below 150L limit after deducting 25% products made and sold by using red mud,where duty rate is nil.
As we remain below 150L(100L for 06-07) we have not registered with excise.
Do we have to file any returns/declarations etc with the excise department?
We maintain all records of red mud purchased and brought to factory and its consumpation details.
Please advise.

SSI exemption


If an SSI unit fails to intimate Excise Department after crossing Rs. 90 lacs sale and the total sale in the year is below excisable limit,is there any penalty imposed?

addtional duty.

Please help me! - I have working in partnership firm, our unit manufacture automobile parts, and we have purchase consumable mtrl. Can I take cenvat credit of additional duty? If yes, where are use those credit ? because, our supplier purchase material from importer & we does sales in local market.
