Dear Sir/Madam,

Please solve my question?

If a excisable unit wants to sale it's packing material (e.g. drum, canes, polybags) in which raw material has come, it is liabile to pay excise duty on such goods. In other words in which packing raw material has come after use of raw material the packing is empty than we wish to sale it, liable to pay excise duty on such packing goods.

Also please confirm that it's mandatory to intimate range which records we maintain at factory.

Is godown necessary for excise registration

Sir, One of my client wants to register for the excise number under the act. Is it necessary to have a godown for the same. Do excise department states that without the godown excise number cannot be issued

Cenvat credit on capital item.

We are manufacturer of plastic moulded item and at present our unit is not registered with excise dept.We will cross the turnover Rs.90 lacs in near future,but under our expantaion plan one machine we are going to purchase during next week.Pl.advice that can we take cenavat credit on this machine purchase when we will get the ECC no. ?

Duty to be paid on capital goods removal

Cenvat credit on capital goods

An item is procured as a capital item as it falls under chapter 82. however in reality it is a consumable and gets consumed within one year. my query to my dear friends is - should we still utilise only 50% in the second year or is there any notification to entitle 100% credit in the year of purchase. thanks for the interest shown. rgds Ramesh

Refund claim of central excise amount paid

Dear Sir

We are giving for manufacturing some products from Ahmedabad we are paying central excise duty and 2% CST there - we are selling those products at Hyderabad - whether we can claim excise duty rebate for those products. The details are given below.

MRP - 300-00
Less Dis @ 35% - 122-50
----------
As sable value - 227-50
E.D @ 6.18% - 14-06

Whether the 14.06 can be claim refund - please explain.

Reverse charge

if cenvat credit not available as we are not providing output service then can we claim refund for service tax paid under reverse charge
