One of our clints got notice stating the assessment was done as per 144. Actually our client is proprietory concern and had made bank transactions for even his personal issues. Actually the tax paid is around 30000. But he sold some agri land and it was also reflected in the bank. Now as authorised representative of client we need to appear before CIT appeals. what could be the remidy available for us to fight with the department.

Can you explain properly??? Sec 144 can be invoke only in 3 cases
1) Assessee has not appeared for assessment
2) Books of accounts are proper - sec 145(3)
3) has not filed the return
Also check before starting Best judgement assessment ITO must have sent the notice. Check from what was the ground for invoking sec 144
