Assesee filled a application for stay of demand after filling a appeal and stay application was not decided and what will be the position of assessed is he is in default or not

As per Section 221(6), the ITO has been given discretionary powers for not considering the assessee as an Assessee in Default in respect of the disputed tax amount. So, in my view, interest till the Appeal is disposed of is generally not charged or may be requested for waiver.
