17 February 2015 Hiee i Have completed 1 year of articleship.
Can't I Take termination and not transfer without Institute's permission and by Mutual consent between me and principal?
Kindly reply at the earliest its very urgent

17 February 2015 Once 1 year articleship completed not possible to take transfer with out ICAI prior permission with a reasonable reason.

17 February 2015 Thanks for the prompt reply but seriously there is no other reason other than mutual consent.Its a normal tiff between me and my principal and no reason as specified by the institute is suitable? what to do in such a case? kindly reply at the earliest

17 February 2015 You should cook a reason for which ICAI and your boss agrees to give transfer.

If you cant do with any of approved reason

Just make an application to ICAI asking permission for transfer along with reason for which you are taking transfer(what ever reason you have) along with your boss approval/no object for your transfer can be submitted to icai.

If icai feels it is necessary to grant leave you may be granted with permission for transfer

17 February 2015 Thanks for the reply.All said and done the principal is asking where is it mentioned in the Institute's site that NOC is required from principal..

17 February 2015 Request him to refer Regulation 56(1) or announcement made by icai in this regard.

Try to find it from Training guide.Can see from here http://www.icai.org/new_post.html?post_id=4639 also,

Where it is clearly mentioned that request can be made on a plain paper with the recommendation of principal.

Ensure you provide evidence if any required to the satisfaction of ICAI.

Request for transfer not accompanied by principal recommendation/consent will not be accepted.
