06 November 2012 I passed CA on 01/04/2012.On 28/09/2012 a private companies accounts were finalised and Tax audited by me.In case of filing of Form 23B with MCA ,what date should i mention for my appointment as i cannot give date prior to my passing date and the company would not be willing to pay any fine for delay in AGM ?
Should the company pass a resolution at EGM to appoint me ?Please suggest

Generally Auditor is appointed at AGM for the whole financial year. For example..M/s AB & Associates, CA is appointed on 25.09.2012 for the FY 2012-13.

I will suggest you to file Form-23B within 30 days from the receving of letter of appointment from Company. But MCA has given liberty to file Form-23B upto 22.12.2012 without additional fee.
