applicability of TDS on stall booking in foreign fairs

15 July 2011 can any one tell me that if i will book stall in foreign fair.now the payment will be made to foreigner.
Now my query is that would i required to deduct TDS on Such amount if yes than provision and Section with Rate of Deduction.but if not deduted than also provision of such payment.

15 July 2011 Income is accruing to a non resident ?

Yes.

Income is arising to him outside India ?

Yes.

Income is being received outside India ?

Yes.

In that case for the organiser the income is not taxable in India and as such No TDs is required to be deducted.
