04 January 2011 Whether Particulars of alternate director has to be given in clause IV of Schedule V ( Annual Return) to be attached with e-form 20B and to be uploaded to MCA Portal.

As per Schedule V of the details of directors is required to be given in Annual Return Format, whether it is alternate director or original director.

In case of E Form-20B, You will fill DIN of alternate director in relevant column.

Other views are also solicited.

04 January 2011 As alternate director ceases to be as such whenever the original director returned and in my opinion if original director is present at the time of AGM, there will be no alternate director and there will be no need to file the particulars of alternate director and in reverse case, as he is representing the original director and original director is absent from India, particulars should be given in form 20B

05 January 2011 Form 32 is filed for appointment and cessation of alternate director as well and the MCA list of directors (view signatory details in DSC option) includes the alternate director as well. Hence according to me the details are to be shown in Form 20B, if he continues to be an alternate director on the date of AGM in Column IV and if he ceased to be an alternate director, then in Column V. Accordngly Schedule V Column IV (Details of Directors - Present and Past) should also contain details of alternate director.
