20 April 2015 As per the Section 161 of the act the tenure of additional director appointed will be till next AGM or the due date of AGM whichever is earlier.

My query is do we need to file any form to RoC in the case additional director vacate the office because of AGM held after 30th Sept

20 April 2015 Yes, you need to file Form DIR-12 with ROC since Additional Director's term will be expired on 30th September. If you see Form DIR-12, you need to select 'vacation of office u/s 161.'

20 April 2015 i couldnt find anywhere option to select "vacation of office u/s 161" also the help of form DIR 12 doesnt include the same

20 April 2015 On page number 2, see the drop down box given in 'In case of cessation'... after the words 'due to'.. You will find this option here.
