269ss and 269t for 3cd purpose

IS Retired Partner capital Account transfer to loan account through book entry . Is come under the ambit of 26SS and 269T.
i searched about it and found that as per Allahab HC ,its will not come under above section but as per guidance note issued by ICAI it will come..
Totally confused. Please Help!
