Service tax charged on rent and paid it to service tax depatment whether it can be adjusted or Refunded from the Service tax depatment.

If Yes than please specify the clause under Service tax Act.

05 September 2008 Please refer rule 4A &B of Service Tax rules 2004(Amended on Finnace Act 2007)

In case of excess paid service tax ,there are two options-

1.There may be suo moto adjustment in further liabilities and disclosure of same must be in half yearly return ST3

2.Refund of service tax claim in form R under rule 173-S of Central Excise Act 1944 within one year to ACCE/DCCE
