Withholding tax on exp for business

can anyone tell me what is the rate of withholding tax rate on the amount paid to US based company (having permanent establishment in India) and the payment is in the nature of business income (neither interest income nor dividend income nor fees for technical services)........

Then the best way shall be to approach ITO foe cetificate for correct determination of tax rate.
Otherwise deduct TDS @ 40% + education cess and surcharge.
