Who is responsible for deduction of tds

can any one help me out regarding the responsiblity lying for deducting of tax..while paying the amount.
where tax is not deducted in my bill amount and the same amount is received by the eventhough i know that the client is to deduct the tax in my bill. is there any penality for me for receiving the whole bill amount.

Its not your responsibility.
If the party is not deducting the TDS, its their fault & you will face any consequences.

and more over i need the particular section , which says that tds deduction is not my responsibility, which lies with the client or deductor
