Filing ITR-4 instead of ITR-2 when treating income from multiple commercial properties as business income is generally acceptable if the income is rightly classified as business income (e.g., rental income from shops/commercial spaces can be considered business income in some cases).
Key points:
If the income is purely rental income from properties, it is usually income from house property and ITR-2 is appropriate.
If the rental income is from multiple commercial properties and the taxpayer is treating it as business income (e.g., managing the properties as a business), then ITR-4 can be used.
Filing ITR-4 after filing ITR-2 by mistake is usually resolved by filing a revised return.
It’s important to classify income correctly. If income is wrongly classified, Income Tax department may seek clarification but generally allows revision.
So:
If the client treats rental income as business income, file ITR-4.
Otherwise, for just rental income, ITR-2 is appropriate.
You can file a revised return to correct the form used.
