How to check liquidation or winding up status of a company: MCA Portal - Company Master Data: If the company is liquidated or struck off, the Status in the MCA Master Data will change to “Struck Off” or “Dormant” or “Under Liquidation”. Since it shows Active as on today, the company is not officially liquidated or struck off on MCA records. View Public Documents on MCA: Absence of documents after 2019 means the company has not filed its annual returns or financial statements since then. Non-filing does not imply winding up or liquidation; it’s a violation of law but the company remains legally active until struck off or liquidated by tribunal/orders. Additional MCA Services: You can order a Company Status Report or Certified Copy of Latest Master Data from MCA portal for official confirmation. The Master Data report includes the latest status, DIN, registered office, etc. Official Notices or Tribunal Orders: Check if any NCLT (National Company Law Tribunal) orders or ROC notices are issued against the company for striking off or winding up. This information may not always be on MCA portal but can be searched via NCLT website or by consulting ROC office. Check ROC Office / Official Gazette: Sometimes companies are struck off by ROC but the public documents may take time to reflect online. You can contact the respective Registrar of Companies (ROC) office for a certified status. Legal Action: Since you want to file a civil suit for recovery of Rs. 9 lakh, as per current MCA data, the company exists as a legal entity. Even if it is non-compliant in filing, it can be sued. If the company is struck off or liquidated later, you may have difficulty in recovery, so act promptly.
