My Client is an assessee who left India for the purpose of employment outside India. His total stay in India is less that 182 days for two years. 3rd year his total number of days in which he stayed in India is more than 182 days.

Now, my question is whether i need to file return of Income for the 2 years in which he was outside India(i.e,, he is non-resident)?

Or

Should i just file the return of Income for 3rd year only?

Should i submit any other proofs that he was outside India during that period when filing is to be done only for 3rd year?

Return of Income is required to file only when as assessee's taxable earned income in india exceeds max amount not chargeable under tax.

So if for those period if he has earned any taxable income which exceeds max taxable income not chargeable under tax then you should file return whether he is NRI or NR or RI.
