ours is construction company, we sometimes go for testing of construction material for eg rmc, sand, steel, iron, bricks etc. and pay testing charges to the agency, my question is that whether payment of testing charges attracts provision of TDS, if yes then under which section, the payment is nearly rs.100000.

TDS is bit complicated subject. 194C and 194J are bit consfusing. However, i will clarify in simple words. Whereever there is unskilled labour/work involved generally 194C will be applicable and whereever skilled labour/work (professional ) are involved 194J will be applicable. So in your case 194J is applicalbe.
