If for Non Audit quarterly dealers payment made on 02-05-2012 for 01-01-12 to 31-03-12,
Whether Panalty will be levied of Rs.5000/- or Interest u/s 30(2) will be levied or both.

As per amendment made to Rule 17 and Rule 18 vide Notification dated 5/12/2011 and Trade Circular no. 3- T of 2012, dated-27/02/2012 The last date for filing the returns for the period ending on 31/03/12, in case of the dealers who are not liable to file the audit report in form e-704, has been extended up to 30th June 2012.
Penalty is for delayed filling of return, due dt is 30.06.2012, yet not over ( being not liable to submit form 704), NO Penalty will attract.
The due date for tax payment was 21.04.2012, the same is paid late this attracts interest.

No penalty will attract as the due date for submission of return for dealers not required to file form 704 is extended till 30.06.2012 as per amendment cir. 3T of 2012.
